Labor Law

EDTIJ — Escobar, Della Togna, Icaza & Jurado
Panama · October 2026 · Estimated reading time: 7 minutes

Panama has opened a new door for the world’s young talent. Through Executive Decree No. 21 of October 13, 2026, published in the Official Gazette on October 14 and in force since that day, Panama created the Working Holiday visa. It lets young foreigners stay for up to a year and take on temporary work. But one detail defines the entire program: the visa, on its own, does not authorize work.

1. What Panama created, and since when

The decree adds the Working Holiday visa to the non-resident immigration category. By design it is a temporary stay: it is granted for up to twelve months, with no possibility of extension, and the holder must leave the country when the program ends. The rule took effect the same day it was published, so it is already part of Panama’s immigration framework.

The program’s logic is one other countries already know: combining a stay to rest and get to know the country with the ability to work temporarily to fund that experience. For Panama, it is also a signal of openness toward young talent at a time when jurisdictions increasingly compete on their ability to attract people.

2. Who can apply

The decree sets clear conditions on some points and leaves others to be developed. What is confirmed so far:

Age: the applicant must be between 18 and 30 years old at the time of filing.

Nationality: the visa is available only to nationals of countries that hold a standing bilateral agreement with Panama for this program. This is the first big unknown: the list of countries with an agreement has not yet been published, so the program’s real availability will depend on those treaties.

Duration: up to twelve months, with no extension.

No change of category: the decree bars the holder from changing immigration category during the stay. It is an entry-and-exit visa, not a route to residency.

As for financial solvency, the decree itself does not set a minimum amount. The specific documents, costs and steps of the process must be confirmed with the National Immigration Service, since the rule is only now taking effect.

3. The nuance that matters most: the visa alone does not authorize work

This is the point that sets this visa apart from an employment authorization, and the one most likely to cause confusion. The Working Holiday visa allows the holder to perform temporary work in Panama, but to do so the holder needs a work permit from the Ministry of Labor and Workforce Development (Mitradel). These are two separate filings before two different authorities: Immigration grants the migratory status, and Mitradel authorizes the work activity.

Having the visa in your passport is not, by itself, permission to work. Without the Mitradel permit, an employer who hires the holder and the holder themselves are exposed to the ordinary labor and immigration penalties.

For a Panamanian employer, this means hiring a young person with a Working Holiday visa requires the same diligence as any hiring of a foreign national: verify the valid work permit before the relationship begins. For the young foreigner, it means the “arrive and work” plan has an intermediate step worth resolving from the start.

4. How it compares to other routes

The Working Holiday visa does not replace the options that already existed; it occupies its own space. It should not be confused with routes that sound similar but work very differently in practice.

Program

For whom

Work it allows

Duration / route

Working Holiday (Decree 21 of 2026)

Young people 18–30 from countries with a bilateral agreement

Temporary employment in Panama, with a Mitradel permit

Up to 12 months, no extension or change of category

Short-Stay Remote Worker / Digital Nomad (Decree 198 of 2021)

Foreigners working remotely for clients abroad

Does not allow work for the local market; foreign-source income

Temporary stay, renewable per the rule

Friendly Nations Visa

Nationals of the listed countries, with an economic tie

Route to residency; the work permit is filed separately

Path to permanent residency

The underlying difference is purpose. The digital nomad works for clients outside Panama and does not touch the local labor market. The Friendly Nations applicant seeks to settle. The Working Holiday traveler comes for a temporary experience and can indeed take a job in Panama, but only with the corresponding permit and for a limited time.

5. Advantages and trade-offs

In its favor

It opens a legal, well-defined route for young people to work temporarily in Panama, something that previously had no dedicated framework.

For sectors with seasonal demand, such as tourism and hospitality, it can be a source of young staff for defined periods.

It projects Panama as a jurisdiction open to youth exchange, with the reputational benefit that carries.

To weigh

It depends entirely on bilateral agreements whose list is not yet known; without a treaty with the applicant’s country, there is no program.

It is not a route to residency: no extension and no change of category.

The Mitradel permit is an indispensable, separate step; ignoring it turns a lawful plan into a labor and immigration contingency.

On tax, income earned from work performed in Panama is, in principle, Panama-source and governed by local tax rules; each case should be assessed.

6. What to confirm before deciding

Like any newly published rule, this visa will have a settling-in period in which Immigration will specify requirements, costs and procedures. Before planning an arrival or a hire, confirm three things with official sources: whether a standing bilateral agreement exists with the applicant’s country, what procedure and documents Immigration requires, and how the work permit before Mitradel is processed in parallel.

The conditions described are based on the text of Executive Decree No. 21 as reported and on the information available at the time of this note. The list of countries with an agreement, the costs and the steps of the process should be verified directly with the National Immigration Service and Mitradel.

Conclusion: a new door, with two keys

The Working Holiday visa gives Panama a tool it did not have: an orderly route for young foreigners to live and work temporarily in the country. That is good news for young talent and for sectors that rely on seasonal staff.

But the visa opens the door with two keys, not one. Immigration grants the status; Mitradel grants the authorization to work. And the whole program rests on bilateral agreements whose reach is still being defined. Choosing well, for the young person who wants to come or the company that wants to hire, starts with understanding that structure before taking the first step.

Are you a young person who wants to come to Panama, or a company looking to hire under this visa?
